Your Responsibilities Quick Summary

Renter is responsible for costs due to: A) theft; B) punctures; C) damages*; D) fines. (*General wear & tear and minor scratches are acceptable. Bikes are inspected at the end of each rental. Damages payable are at the discretion of CEB.) Renter agrees to: A) not ride scooters through puddles or in rain (bikes are better in the rain but heavy monsoon rain should be avoided.); B) not ride on sand; C) not ride on the skate rink or attempt stunts/jumps. D) abide by the road rules E) when renting overnight, return bike/scooter with a fully charged battery; F) pay a call-out fee if renter needs a rescue; G) pay for extras not returned; And a proportional deduction for late returns of more than 15 minutes. Call-out fee: between $25* - $40** *Cairns North, Edge Hill, Manoora, Manunda, Westacourt, Bungalow & Portsmith. ** Not beyond Palm Cove, Gordonvale or up the range. Puncture/call-out insurance: $6 per day, per hired item, covers you for 1 tyre and tube replacement and a call-out for theft, major accidents, flat tyres or issues that prevent the rental being ridden. (Limited to city limits of Stratford, Freshwater, Redlynch and White Rock.) Cancellation: Refunds will be granted up until 24 hours before the rental start time.  A processing fee of $15 will be taken.  

Full Terms and Conditions.

1. Assumption of risk: - Renter acknowledges that the activities for which the bike/scooter is designed includes inherent dangers, including the risk of bodily injury and/or death. Renter assumes and accepts all risks associated with the use of the bike/scooter. - Renter accepts full responsibility for the care of the equipment whilst in the Renter’s possession, control and use. This includes agreeing to pay for all costs, charges, fees and expenses whatsoever associated with equipment being lost, stolen, or damaged whilst being under the use and control of the Renter under this Agreement. - That Cairns Electric Bikes (CEB) has provided all necessary instructions for the use, including safety instructions for the equipment, and the Renter has fully understood such instructions. Note that it is the Renter’s end responsibility, if they feel they have not received sufficient instruction, to ask for further clarification either at time of instruction or post event. - Renter agrees to fully release and discharge CEB from any liability whatsoever for any damage, injuries or claims. Including any injuries or damages to the Renter or any third party or other person/s or to the Renter’s property or third party property, as a result of Renter’s use of the bike/scooter. 2. Acceptable use: - Renter agrees and acknowledges that he/she will use the bike/scooter in a careful, safe and conscientious manner. - Renter shall observe and adhere to any rules and guidelines posted by CEB, and applicable laws/regulations. - Complimentary helmets come with every hire. Renters who choose not to wear one accept any consequences of not wearing a helmet. - Renter will NOT ride the bike/scooter on the beach, sand, water, through puddles or in the rain. (bikes are expepted to ride in mild to moderate rain, but heavy/monsoon rains should be avoided.) Should the Renter do so, the product may be damaged, requiring it to be dismantled thoroughly cleaned and re-assembled, the costs of such will be borne by the Renter. 3. Condition of bike upon return: The Renter shall return the bike/scooter in the same condition as it was in when given to Renter, excepting ordinary wear and tear. Renter shall be responsible for any damage caused to the bike/scooter during the rental period. Renter shall be billed by CEB for the full amount of damages caused by Renter during the rental period, including reasonable legal fees. CEB shall debit the Renter’s credit card as necessary to cover repairs for such damages. 4. Late return: - If Renter returns the bike/scooter more than 15 minutes after the scheduled “time back,” the Renter accepts bill for additional time and loss of potential following booking. - Renter consents to and authorises CEB to debit the Renter’s credit card to cover the cost of any breach by it of this agreement.
